Public Utilities Regulatory Policy
Act of 1978 (PURPA)

Whitewater Valley REMC invites member participation in a public hearing to be held at the Union County 4-H Building, 411 Patriot Blvd., Liberty, IN, on July 10, 2007 at 9:00 a.m.

Electric utilities across the nation are making preparations to respond to the Energy Policy Act of 2005’s (EPAct) amendments to the Public Utilities Regulatory Policy Act of 1978 (PURPA). The five standards are: (1) Net Metering, (2) Time-Based Metering and Communications, (3) Diversity of Fuel Sources, (4) Fossil Fuel Generation Efficiency and (5) Distributed Generation Interconnection. Whitewater Valley REMC is not required to consider the proposed standards, but the Board of Directors has adopted a Resolution which directs Whitewater Valley REMC to voluntarily consider the standards and to receive its member input in that consideration process. The Whitewater Valley REMC Board will consider and determine “whether or not it is appropriate to implement such standard(s)” within certain defined time lines based on evidence collected from interested persons after the public notice and hearing. If no requests to participate in a public hearing are submitted, there will be no hearing (which fact will be noticed online at least one week before the scheduled hearing), in which case the evidence considered will be the initial and reply comments.

What is PURPA?


The Public Utility Regulatory Policies Act (or PURPA) was a law passed in 1978 by Congress as part of the National Energy Act.  It was meant to promote greater use of renewable energy, among other things.

Title I of PURPA was designed to encourage conservation of energy supplied by utilities, promote optimal efficiency of electric utility facilities and provide equitable rates for consumers.

This law created a market for non-utility electric power producers, requiring utilities to buy power from these producers at the “avoided cost” rate with is the cost the electric utility would incur were it to generate or purchase from another source.

The Energy Policy Act of 2005 (or EPAct) is a statute that was passed by Congress and signed into law on August 9, 2005.  The Act, described by proponents as an attempt to combat growing energy problems, provides tax incentives and loan guarantees for energy production of various types.

The Act was intended to establish a comprehensive, long-range energy policy.  It provides incentives for traditional energy production as well as newer, more efficient energy technologies, and conservation.  More than 1,700 pages long, the act has hundreds of provisions including the five electricity titles we are discussing here.
